Sellers Terms

​MyCustomJournal​​​ allows sellers to create campaigns and sell custom planners, journals, and other similar type products through their campaigns. The following are specific obligations regarding the initiation of any campaign. To the extent any campaign violates these policies, we may choose to terminate, delay or modify the campaign at our discretion. For additional information, please see our FAQ’s post.

​By creating a campaign through the MyCustomJournal service, you represent and warrant that you have the rights to use the images, files and wording on the campaigns, including the rights relating to the name, description, images, text or URL used for the campaign.

MyCustomJournal does not claim any rights to templates or images you upload to the MyCustomJournal service unless you’ve used our templates, where we grant you the rights to use in our system.

MyCustomJournal (DIME Consultants Inc.) retains all ownership ​in any designs created by us, and may not be used by you outside of the MyCustomJournal’s system without the express written consent of DIME Consultants Inc. (That means: you cannot take our templates to publish ​and fulfill elsewhere without having purchased limited developer rights, which we supply on occasion).

You must keep your records of proof of that developer purchase if you wish to fulfill through another source (such as createspace).

For the purpose of implementing and fulfilling your campaign and for the purpose of advertising the MyCustomJournal Service in any medium MyCustomJournal chooses, you hereby grant MyCustomJournal a nonexclusive, worldwide, fully paid up, transferable, sublicensable license under your Campaign Rights to copy, display, distribute, modify the content you upload to the MyCustomJournal Service (including all related images, text, content and information.

SELLER MEMBERSHIPS

In order to become a Seller with MyCustomJournal,​ at this time we are not accepting free memberships.

​Part of what MyCustomJournal offers is a membership section for Sellers to learn how to create and sell various products. Included is additional templates as part of the paid membership, and other perks and features not available to sellers who join free.

Free memberships are not available at this time, but will be open at a later date.

​Paid Memberships are available on a limited basis in order to receive these additional perks.

​MyCustomJournal allows you to sell products created by us, but customized by you, to customers around the world. (See Create And Sell for details).

​To become a seller, you agree to abide by the following rules and guidelines:

  • ​You must not make any false claims on your product offers.
  • You may promote your offers any way you see fit such as on social media or other free or paid advertising methods, except spam.
  • You must not send unsolicited emails (SPAM) to your product offers. We have a strict zero tolerance policy. If a person files a complaint, we will investigate to see if it is a legitimate complaint. If multiple reports are received, your account will be frozen or removed and no monies due will be paid.
  • You must not attempt to claim you are an officer or staff member of MyCustomJournal.
  • You are provided the rights to use any of our templates and modify them as you wish. You can add your copyright notice on them, however you can NOT request for us to remove any similar templates or products as we own the original underlying copyrights on all templates.
  • If someone has blatantly copied your exact product, layout, covers etc – please submit a complaint to our legal team. We do not tolerate members who steal from others by replicating the products unfairly.
  • That means – do not replicate the products/covers exactly as another seller just to try to steal their sales. It’s unethical and won’t be tolerated.
  • You must ​comply with our Acceptable Use Policy.

Due to the information included, the templates and access, training and so on, there are no refunds on the memberships.

​CANCELLATIONS:

​Lifetime memberships are no longer offered, and therefore are specially granted to those who took advantage of special pricing during the time of offering. If you have a lifetime membership, there are no refunds on the membership levels. If you choose to cancel your membership, please be aware you will also lose your lifetime membership access. ​Cancellations can be done by following the instructions below in the “How to cancel” section.

Annual memberships: If you have an annual membership, you may cancel your billing agreement at any time. Your access will remain until the year completes, and at that time, your access will ​be cancelled. There are no pro-rated refunds on annual memberships. Cancellation ​can be done by following the instructions below in the “How to cancel” section. Cancellation must be provided prior to the next ​year’s payment coming out.

Monthly memberships: ​If you wish to cancel your monthly membership payment, this can be done by following the instructions below in the “How to cancel” section. Cancellation must be provided prior to the next month’s payment coming out.

HOW TO CANCEL:

If you wish to cancel, please submit a ticket to our helpdesk (found at the bottom of any part of the site) with the subject Cancellation Request. Be sure to include the appropriate information (your username etc) for further billing to be cancelled.

Please be sure to submit your request at least 2 business days prior to cancellation to ensure it does actually take place. Be aware our staff does not work evenings or weekends, and therefore if you submit at 1 p.m. on a Friday afternoon Eastern time zone (Canada), ​it is highly possible that billing may not be cancelled prior to Tuesday morning. While we strive to always respond within 1 business day, occasionally things happen, such as a cross over of time zones between yourself and our staff, as well as local holidays for our staff.

If a payment goes through and you have requested cancellation prior, we will cancel and refund that payment. However if a payment goes through, cancellation and refund will only take place within the first 24 hours of it.

Any account balances (Commissions) owing to you on your campaigns will be remitted as per the usual payout policies, providing your account remains in good standing.

Any chargebacks will be viewed as fraud, actively fought against, and your account will be permanently terminated.

​ABUSE

​Abuse of our staff members and moderators will not ever be tolerated. Swearing, attacks, and rude behavior will result in an immediate ban on your account, and all monies due ​may be forfeited.

We reserve the right to cancel an account if a seller acts abusively towards our staff, or members of our forums in any way.

We respect all members, and ask that you show the same proper respect.
